Hometown Websites (www.hometownwebsites.ca)
Effective date: October 21, 2026
Last updated: October 21, 2026
1. Agreement to these Terms
These Website Terms of Use (the "Terms") govern your access to and use of www.hometownwebsites.ca (the "Site"), operated by Hometown Websites, a business of DB Capital Group (an unregistered sole proprietorship) ("Hometown Websites", "we", "us"). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site. Hometown Websites is a business of DB Capital Group.
2. Definitions
"Content" means all text, graphics, images, logos, designs, code, data and other material on the Site. "You" means the individual using the Site and, if you use it on behalf of a business, that business.
3. Permitted use
You may view and use the Site for your own lawful, non-commercial information purposes. You must not: (a) copy, reproduce, republish, scrape, frame or create derivative works from the Content except as expressly permitted; (b) attempt to gain unauthorised access to the Site, its servers, the client portal or administrative areas, or test their vulnerability; (c) introduce malware or interfere with the Site's operation; (d) use the Site to send unsolicited messages or to collect information about other users; or (e) use the Site in breach of any law.
4. Intellectual property
The Site and its Content are owned by or licensed to DB Capital Group and are protected by the Copyright Act and the Trademarks Act (Canada) and international treaties. All rights not expressly granted are reserved. Hometown Websites, DB Capital Group and the associated crests and logos are trademarks (™) of DB Capital Group. Nothing on the Site grants a licence to use any trademark without our prior written permission.
5. Quotes, prices and estimates
Prices on the Site are in Canadian dollars and exclude applicable taxes. The price estimator and package descriptions are estimates and invitations to request a quote, not offers capable of acceptance. A binding engagement arises only when you and Hometown Websites sign a Website Design & Care Services Agreement or accept a written quote that incorporates it. If the Site and a signed agreement conflict, the signed agreement governs.
6. Sample and demonstration websites
The demonstration websites on the Site depict fictional businesses. Their names, hours, reviews, ratings, prices and other details are samples created to show features; they do not describe any real business, and any resemblance to a real business is coincidental. Demonstration code and designs remain our property.
7. Client portal
Access to the client portal is limited to clients and their authorised users. You are responsible for the security of the email account to which login links are sent and for activity under your access. Notify us promptly at [email protected] of any unauthorised use.
8. Communications
If you contact us, you consent to us replying by the method you used or chose. You can ask us at any time to stop calling, texting or emailing you, and we will add you to our internal do-not-contact list.
Accuracy and availability
We take reasonable care to keep the Site accurate and current, but the Content is provided for general information and may contain errors or become out of date. We may change, suspend or discontinue any part of the Site at any time without notice.
Third-party links and content
The Site may link to or embed third-party websites and content. We do not control and are not responsible for them, and a link is not an endorsement.
Disclaimer of warranties
To the fullest extent permitted by law, the Site and Content are provided "as is" and "as available", without warranties or conditions of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of or inability to use the Site, and our total liability for any claim relating to the Site is limited to C\$100. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including the Business Practices and Consumer Protection Act (British Columbia) (https\://www.bclaws.gov.bc.ca/civix/document/id/complete/statreg/04002_00). Any agreement for paid services is governed by its own terms.
Indemnity
You agree to indemnify us against claims, losses and reasonable costs (including legal fees) arising from your breach of these Terms or misuse of the Site.
Privacy
Our Privacy Policy and Cookie Notice explain how we handle personal information and form part of these Terms.
Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. The courts of British Columbia (and, for claims within its jurisdiction, the Civil Resolution Tribunal, https\://civilresolutionbc.ca/) have exclusive jurisdiction, except where consumer protection law gives you the right to bring a claim elsewhere.
General
If any provision of these Terms is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver. We may update these Terms by posting a new version with a new "Last updated" date; continued use after that date means you accept the updated Terms.
